Riverside asked the California Supreme Court to let them ban medical marijuana on Tuesday. On the other side of the country, members of Congress tried to make pot legal.
Many cities and counties are not in favor of California's Compassionate Use Act. Riverside used zoning laws to push a dispensary out of town.
Judges will decide whether or not that's legal. Here in Fresno, Sheriff Margaret Mims is using another law to keep marijuana out of the Central Valley.
She says cooperatives, not dispensaries, were allowed by voters in 1996. Mims says dispensaries are not well regulated and pass out marijuana prescriptions without medical cause.
Under a different administration, the Feds agreed. Fresno received grant money to prosecute dispensary owners.
What a difference a decade makes.
Now members of Congress are calling for an end to the war on marijuana. States that legalize it would be left to their devices.
Proposed legislation would turn the ATF into the ATMF. Marijuana would be taxed and regulated much like tobacco and firearms.
The plan is said to have bi-partisan support. Although it will be awhile before the arguments on Capital Hill, and at the State Supreme Court, will be decided.
