Fresno State wants new trial

Former Fresno State women’s basketball coach Stacy Johnson-Klein and her camp continue to celebrate a $19.1 million legal victory, going on KMJ 580's "The Ray Appleton Show" Tuesday afternoon to tell her side of the story. Meanwhile, Fresno State attorney Mick Marderosian says this fight is far from over.

"We are going to move for a new trial. We will request a change of venue and continue to push for a right to a fair trial," Marderosian said from his downtown Fresno law office.

Though the attorney would not go into details, he claims there are issues which need to be addressed including the possibility of juror misconduct. The fact the jury reached a unanimous decision in less than four hours, he said, may be an indication the university did not receive a fair trial.

"This motion for a new trial is going to address the issues and to cause further analysis before this is all over. It's too easy to say it's clear the university is wrong."

Marderosian also said the university did want to reach a compromise before this case went to trial but the two parties could not come to an agreement. Johnson-Klein attorneys told reporters last week they would have settled with Fresno State for $950,000.

KSEE 24 News calls to Johnson-Klein's attorneys for comment on requests for a new trial were not immediately returned.

Meanwhile, university officials addressed the financial effects from the multi-million dollar verdict, as well as other settlements against Fresno State in the past year.

"This will absolutely not impact student fees. This university has an operating budget for insurance," said Cynthia Teniente-Matson, CSUF vice president of administration and chief financial officer. "It will not impact the faculty operations or programs or jobs."

Teniente-Matson says the school will pay a $100,000 deductible and an insurance policy will cover the rest of the damages awarded to Johnson-Klein. The same, she says, will be true for two other cases. Former associate athletic director Diane Milutinovich and former women’s volleyball coach Lindy Vivas settled for millions in their lawsuits against Fresno State.

Still, many wonder about the long-term effects; this was the topic in Sacramento today.

Sen. Dean Florez (D-Shafter) has announced a Jan. 9 hearing into the school's leadership and on-going legal woes.

Last week, Florez had called for the immediate resignation of Fresno State President Dr. John Welty.

“[Under Welty’s leadership] the school has been penalized more than $27 million for discriminatory actions toward female employees within the school’s athletic department,” Florez wrote in a press release issued Tuesday.

Welty has refused to step down and CSU Chancellor Charles Reed continues to support the embattled president.

"It is clear to me that Chancellor Charles Reed has become too invested in the outcome of these matters and has not made decisions in the best interest of the California State University as a whole," Florez added in his statement.

Many of the key players - including Welty, Johnson-Klein, Reed and a host of attorneys - are expected to be called to testify during the senate committee hearing on gender discrimination and Title IX compliance in Sacramento next month.

The hearing is slated for Jan. 9 at 10:00 a.m. at the State Capitol.
