Prosecution wraps up in sex crimes case

Over the last couple of days, Mackie Davis has really been all over the place while on the stand, going back and forth on his testimony, numerous times.

Initially Mackie Davis told defense attorneys that he recorded and witnessed Eddie Scott receiving a sex act from the alleged victim... an 11-year-old girl.

But today, when cross examined by the prosecution, a new story emerged.

For a second day in a row, former Reedley football player, Mackie Davis fielded questions from both the defense, and prosecution, about the night, back in July of 2006, he and others engaged in sex acts with an 11-year-old runaway.

When Davis took the stand yesterday, he told defense attorneys that he recorded Scott receiving a sex act from the young girl on his cell phone's video camera.

He says the video he shot was about 45-minutes long.

Davis, however, did not admit to witnessing Scott have sexual intercourse with the girl.

That was, until he was cross examined by the prosecution today, admitting to not only witnessing Eddie Scott receive a sex act from the 11-year-old girl, but also witnessing Scott and an unidentified man, taking turns having sexual intercourse with her.

The prosecution also played a portion of the cell phone video to Davis, several times, that he initially said was 45-minutes long, and included Scott receiving the first sex act in its entirety.

But that story quickly changed too.

He told the prosecution that the video was only really about 10 minutes long and it only included a portion of the initial sexual encounter

When Davis accepted his plea deal, he agreed to truthfully testify, and for doing so, would have eight years of prison time waved and not have to register as a sex offender for the rest of his life.

Once Davis' testimony concluded today, the defense began presenting its case, calling its first witness to the stand, a Fresno County public defender.

Defense attorneys say they are not sure whether they will call Eddie Scott to the stand.

This case is expected to wrap up sometime early next week.

If convicted, Scott could receive eight years in state prison and have to register for the rest of his life as a sex offender.

Court proceedings will resume tomorrow.
