EXCLUSIVE: Jailed Fresno soldier gets national attention

A judge in Mexico City will now decide the fate of Fresno Army Specialist, Richard Medina Torres.

Tonight... The Iraq war vet remains in a Mexican prison, while his mother anxiously awaits the judges decision.

"He says mom, all I want to do is continue to serve my country,” said Gloria Medina, the soldier’s mother.

But tonight it is unclear if Fresno Army Specialist Richard Medina Torres will be released in time to even make to his next deployment.

He was supposed to leave for Honduras today.

Now, the U.S. Army tells his mother it’s planning to make some accommodations for the soldier if and when he's released.

"They're calling him a victim of circumstances and say that they're going to try and keep his Honduras slot open for him, they're backing the date up to his arrival time there,” said Medina.

The Iraq war vet's story is now gaining national attention... His ordeal... Airing this morning on "MSNBC Live."

His mother is hoping that along with added pressure... Will come added support from military officials.

"He's been left hanging, and he's just wondering too, why am I still here mom, why is the Army not doing something, because he is a U.S. soldier,” said medina.

Who could be sentenced for up to 7 years in a Mexican prison if a Mexico City judge does not drop the charge against him.

It’s a decision that could happen any minute now.

Meanwhile, U.S. and Mexican officials met to discuss dropping that charge on Monday.

The Mexican magistrate in Mexico 's court of appeals said he would give it strong consideration, but said it could take up to 3 weeks to make a ruling.

"I'm just hoping that he comes home soon that this ordeal, this nightmare will end soon,” says Medina.
