Jury finds defendant guilty in University Village fire

Late Monday afternoon, a jury found David Damore guilty of arson of a structure, causing great bodily injury.

He was accused of setting the University Village Apartments" on fire back in 2003.

Earlier Monday, the defense and the prosecution presented their closing arguments.

On May 20, 2003 the University Village Apartments went up in flames, just weeks before they were scheduled to open.

The fire was one of the costliest in Fresno history, causing 14 million dollars in damage.

The defendant, 26-year old David Damore, admits he started the fire, but his attorney argues that he should not be convicted of aggravated arson, but rather a lesser charge of reckless burning of a structure because he was not willful or malicious at the time of the crime.

The most serious charge against Damore is aggravated arson, which is defined as causing more than 5 million six hundred and fifty thousand dollars in damage to a structure.

The district attorney says that is exactly what happened in this case.

The defense argues there was no way for Damore to know that his actions would result in such extensive damage, and that he had no motive for committing the crime.

The prosecution says they do not have to prove why Damore did what he did, simply that he acted intentionally.

The jury agreed with the defense argument, finding him guilty of the leser charge. The defense attorney says his client could face up to 8 years in jail, but he is going to seek probation in the case.
