CAUGHT ON TAPE: Fresno Police Officers Violent Arrest of a Homeless Man

On Tuesday, KSEE 24 News exclusively obtained a video tape of two Fresno police officers punching a partially restrained homeless man, 52 year old Glen Beaty, as they arrested him.

The incident took place Monday morning just before 10 o'clock in an empty dirt lot near the corner of Bullard and Blackstone in northwest Fresno.

The person who recorded the video said while he did not want to reveal his identity, he felt compelled to hand it over to KSEE 24 News in hopes of protecting those who cannot protect themselves.
He told us, "They grabbed him (Beaty) and threw him to the ground. I just saw him being brutally beaten because he didn't want to listen to them."

The tape shows Beaty lying face down on the ground being hit at least 6 times in the face.

It appears 2 of the blows came after Beaty was partially or fully restrained with his hands behind his back.

The footage was shown to Fresno Police Chief Jerry Dyer, who immediately launched an internal investigation.

Dyer said what could be most important to the investigation is the 8 or so minutes prior to the recording.

Dyer said, "The individual was stiff. There was alcohol around him. It was very apparent that he had been drinking excessively and when the officers contacted the individual there was resistance in terms of the line of questioning. The individual refused to answer certain questions and at some point there was an altercation that occurred between the suspect and the officers. At one point, the officers, one of the officers was punched by the suspect in the arm. The officer had his badge ripped off of his shirt. "

Chief Dyer's account of the incident is based on the police report written by the two officers in question.

The person recording the footage admitted to not being on the scene when the officers first approached Beaty, but challenged Dyer's chain of events.

He said, "Before the camera went on I saw him (Beaty), he had already pulled his body away from the tree a little bit and started trying to keep them from grabbing his arms and when they did get a hold of his arms, they spun him around and put him on the ground and started socking him."

Even though an ambulance was called and used to transport Beaty to the hospital, officers on scene did not gather any witness statements.

But, Chief Dyer said the Fresno Police Sergeant heading the investigation of his fellow officers' conduct will be reaching out to anyone who witnessed this incident.

"What is important to us though is to allow all of the evidence to be brought into this case, any witness statements, all the actions that led up to the video being taken before an official opinion is formed."

making things simple and short, but as an enforcer of the law and icon of the community, brute force should be last on the list to be use. if it is used it is only up till one is subdued. despite what we could not hear or did not see before, the video shows that these officers were striking repeatedly even after they had the gentleman pinned to the ground. breaking the law or not, someone with such privaledged authority should have better moral and ethical behaviors.

When an officer comes out he has the oblegation to listen to both sides of the story involving two parties before making a decision. It's the fair way to handle business to both parties. It would be nice to give the officers the same consideration before we take sides. We want them to hear all our story first before we are found guilty. As a manager of a local business in the area I applaud the actions of the police. These homeless daily drive my business away. People think they are being kind giving them money when they beg at the corner. I personally see them everyday buying alcohol getting drunk, making messes, smoking, and they smell horrible, leaving a stench behind them when they come into my business. It is amazing that these two highly trained officers were unable to better control this subject. He even start to get up to his feet. What gives? You might consider that if they had better training, more practice, they might have controlled him better and the one officer would not have lost control and punched him..appears to me that a lack of experience, training or confidence is to blame. The officers were obviously in no danger, and it is their DUTY to be patient, even with obnoxious and disobedient suspects. Maybe the best tactics were not used, however, time place and circumstance people thats what the officers dealing with the situation have to be mindful of, not the repercussions from the public who only have the chance to see half of the incident without audio. I am one of the few that actually paid attention to Glenn living in the bushes all these months. I give him breakfast, bought his luggage and clothe him when I can afford it. He has never done anything disrespectful and has always been very gracious and polite. I see him every morning and he isn't out there asking for handouts. He's just trying to survive. I find this video and the circumstances very disturbing as my family knows Glen.He is a quiet man who stays to himself.He is homeless but he has pride in himself and has always been soft spoken and very respectful. I have no respect for Fresno police after viewing this video; I do not see Glen even trying to protect himself. His arms are down and then his face is in the dirt. My daughter cried when she saw what they did to him. Shame on Fresno for having such a police department.

The officers were no longer in any danger, and any retaliation at that point is nothing more than anger. If the man refused to answer any questions, that is his constitutional right.
