Glen Beaty could spend the next three years at Atascadero State Hospital, as mental health experts there attempt to help Beaty regain competency to stand trial.

He faces charges of parole and restraining order violations. He was arrested in February 2009. A viewer capture on tape, two Fresno Police Officers hitting Beaty as they attempted to take the homeless man into custody.

The ACLU's civil action against the City is pending. No charges have been filed against the officers identified in the video. A Fresno Police spokesperson who only confirm that the officers are currently employed by the City of Fresno.

Beaty's attorney Peter Kapetan said Thursday morning, that his client believes involuntary commitment to Atascadero violates his Constitutional rights. Kapetan said he believes medication will help his client with his mental illness.
