Jury selection for the trial against Jorge Banda began Monday. Banda is accused of killing sheriff's detective Kent Haws back in 2007.

The trial has been delayed because of questions about Banda's mental competency. Jurors decided that he is competent to stand trial, but psychologists say he is mentally disabled.

The supreme court ruled executing mentally disabled people constitutes cruel and unusual punishment. Banda now faces life without the possibility of parole.
