(Press Release) Fresno County District Attorney Elizabeth A. Egan announced on Wednesday the filing of an indictment alleging 180-count felony real estate fraud case against Fresno residents: 37-year old Justin Dee Linder, 32-year-old Kelly Jo Linder, 37-year-old Gregg Borchardt, 68-year-old Hector Secco, 30-year-old Ryan Leffingwell, and 27-year-old Amy Leffingwell. The indictment included felony counts of grand theft, recording of false documents, false notarizing, identity theft and welfare fraud charges.
Justin Dee Linder was indicted on 179 and Kelly Jo Linder on 173 of the above felony counts plus enhancements that the property taken was worth more than $3,200,000, and that a felony was committed while out of custody on their own recognizance in a felony case.
Gregg Borchardt was indicted on 51 felony counts of real estate fraud including grand theft, recording of false documents, false notarizing and an enhancement for taking property worth more than $1,300,000.
Hector Secco was indicted on 5 felony counts of false notarizing.
Ryan Leffingwell was indicted on 7 felony counts and Amy Leffingwell on 6 felony counts of grand theft and an enhancement for taking property worth more than $200,000.
The Indictment alleges that between December 10, 2004, and April 4, 2007, the six named defendants were involved in a series of illegal real estate transactions in Fresno, Madera and Riverside counties that resulted in over $11,000,000 in fraudulently obtained loans.
The Indictment further alleges that from February of 2008 until May of 2011, Justin and Kelly Linder fraudulently obtained public aid in the form of welfare. From 2004 until 2007, Justin and Kelly Linder owned and operated Summit Mortgage Services in Fresno County. Gregg Borchardt worked for Summit Mortgage Services as a licensed real estate agent and notary public during 2006. During this same time period, Hector Secco was employed as a notary public and Ryan Leffingwell was a licensed real estate agent that did business with Justin and Kelly Linder.
Bail was set for Justin and Kelly Linder in the amount of $2,000,000 and arrest warrants were issued by the court. Kelly Linder was taken into custody on October 25th and is scheduled to be arraigned Thursday morning. The court’s warrant for the arrest of Justin Linder is outstanding.
