Court: Megan Martzen Trial 'Still On'

The trial is still "on" for a babysitter accused of killing a 17-month-old, but Megan Martzen's attorney is hopeful the trial will be dismissed because of some new developments.

Wednesday the defense dropped a bomb that could blow up the prosecution's case. Martzen's attorney, Jeff Hammerschmidt, confirmed the lead medical expert who first called this a homicide is now calling the incident accidental.

The prosecution's side is yet to confirm this. Also at issue: the prosecutor who started out on the case is now working with the defense. Hammerschmidt says Burton Francis will not work on this case, but a conflict hearing was set for later to discuss that issue.

The defense says the medical expert's opinion was crucial to the other side.
