Kyle Scarber, the father of a convicted rapist has bailed out of jail.
Scarber is an assistant chief with the Highway Patrol.
He's accused of filing a false police report and helping his son escape imprisonment.
His son, Spencer Scarber was on the run for 2 months...
He disapeared 3 days before a jury found him guilty of rape and robbery.
Immigration officials captured spencer on Thursday in Acapulco, Mexico.
A search warrant was served at the scarber home yesterday...
Fresno county sheriffs deputies arrested Kyle Scarber along with his wife and daughter.
Authorities say they all helped spencer leave the country.
In a press conference yesterday, Sheriff Margaret Mims said the CHP is fully cooperating with the investigation.
"It's always unfortunate whenever we have to criminally investigate a law enforcement officer, but investigate we must."
Spencer Scarber remains in jail, and is awaiting sentencing.
As for his mom and sister, Gail Scarber and Crystal Reynoso, they are eligible for bail, but according to sheriff's deputies, have not yet posted.
