The trial continued Wednesday even though the defendant, 20 year old Spencer Scarber, was not in the courtroom.

Scarber is accused of breaking into a neighbor's home and raping a 35 year old woman at knifepoint, back in July.

The prosecution had rested it's case Tuesday. The defense was set to present it's case Wednesday, but Scarber never showed up.

The man was reported missing from his Squaw Valley home early Wednesday morning. Scarber's father told detectives he found some blood on the driveway and a pair of crutches his son had been using.

The sheriff's office would not release any additional information Thursday, but the trial did go on with closing arguments.

The court has ordered Scarber's bond be revoked. There is now a warrant out for his arrest, with bail set at more than $1.5 million.

Following his rape arrest, Scarber was arrested again and charged with unlawful sex with a minor.
