"Fresnans for Clean Air" filed a lawsuit against the City of Fresno. Now they're putting it on hold.
FRESCA says they're not out to bankrupt the city. Legal fees fighting their lawsuit could cost hundreds of thousands of dollars.
So FRESCA is letting the city council make a move before they make theirs. February 7th is when councilmembers will meet behind closed doors to discuss residential trash privatization.
FRESCA is arguing the deal with Mid-Valley Disposal will be bad for the environment. They say garbage trucks will have to drive an extra 40-50 miles to Kerman to remove the city's waste.
They city favors the ordinance in their effort to try and close a multi-million dollar budget deficit. Without the extra $4 million in revenue generated by the trash contract, Fresno could cut 50 jobs, slash other city services, or end up in bankruptcy court.
If the city council does not change course on privatization, the matter could be left up to registered voters. A special election will be called or a measure could hit the 2014 ballot.
If that's the case, FRESCA's lawsuit will be back on, joining the still-active lawsuit filed by Sunset Waste over the commercial trash contract. Sunset is asking the city for damages ranging from $8 mil to $16 mil.
